Beck v. Prana Eight Properties, LLC
Our client prevailed against tenants represented by Raquel Fox of the Tenderloin Housing Clinic. Tenants were trying to force their landlord to maintain an illegal fire escape that the tenants used to access another building and rear yard areas of adjoining house also owned by the same landlord. It turns out that two of tenants own and reside in their own home elsewhere and have been subleasing their unit. We filed an anti-SLAPP motion and the case was thrown out on appeal. Our clients then collected all of their attorney’s fees and costs for winning the case. It is not true that tenants always win in San Francisco.
10/22/2007 - Another important appellate victory for San Francisco property owners.
In a newly published opinion, Division Three of the First District Court of Appeal held that a tenant’s lawsuit over an attempted eviction arises from the exercise of the right to petition, and therefore triggers the anti-SLAPP statute.
