STATE SUPREME COURT GRANTS REVIEW IN DROUET AND SITES CASES
The California Supreme Court has decided to review two more cases out of our office, Sites v. Superior Court (2001) 86 Cal.App.4th 504 and Drouet v. Superior Court (2001) 86 Cal.App.4th 1237 . In Drouet, we have requested the state's highest Court to overrule its previous decision in Nash v. Santa Monica (1984) 37 Cal.3d 97 and decide that an property owner's constitutional right to go out of the residential rental business trumps a defense or claim of retaliatory eviction. In Sites, the High Court will decide whether further judicial review is available in cases where the Appellate Division of the Superior Court has issued an unpublished affirmance of a trial court judgment.
